“I am looking for justice. Together with my children who were born in Indonesia and my colleagues here. May God, whom I exalt and glorify, help me, my family and all. Thank you,” said Akudo Agnes Ejizu (wife of the victim) in the middle supporters and attorneys for the family of David Ibeneme Ejizu (56 years old, victim).

Ronauli Silaen SH, Mr. David’s lawyer who also helped translate into Indonesian stated, the victim was an elder and respected person in Nigeria and in Indonesia. “He has a generous heart and likes to help others. Even one minister in the Indonesian church, namely the Anglican Church. Mr. David is also an active member of the Indonesian Nigerian Community (NCI: Nigeria Community Indonesia),” said one of his lawyers, Ronauli Silaen SH.

Anggiat’s lawyer, Anju Hutasoit SH, emphasized that his client was arrested and detained without fulfilling legal procedures in this country. “This was the work of police officers at the Indonesian National Police Headquarters (Mabes Polri) cq Ciber Crime. They have arrested people and detained victims since January 29 and were only given arrest warrants when our client finished being interrogated at night at Headquarters after being arrested and Our client moved to the Cipinang Detention Center (East Jakarta) around May 26, 2023. And it violated the Criminal Procedure Code (KUHAP) and the Police Chief’s Criminal Procedure Code. Therefore it must be null and void. Until this Pre-Trial hearing was held on June 26, 2023, the letter for the confiscation of documents, goods and money has not yet been received. The arrest and detention warrant was given to the victim’s wife after she visited the 15th floor of the National Police Headquarters, on June 6, 2023 with us as the lawyer for the victim’s family. Our arrival at the same time asked for a BAP (News Examination Procedure) but was not given. The reason was, they were off duty. And until the end of the first Pre-Trial hearing on 26 June 2023 late in the afternoon, the Dossier was also not given. An arrest warrant was also given to Mr David after he was taken to the National Police Headquarters and interrogated in the evening,” said Anggiat Anju Hutasoit SH.

He added, this was a resistance to tyranny or the irresponsible actions of members of the police at the Criminal Investigation Agency (Bareskrim) of the Indonesian National Police (Polri). “Our client was accused of violating Article 27 Paragraph 3 of Law Number 11 of 2008 Concerning Electronic Information and Transactions (ITE) without evidence, without confiscation warrants, and without arrest warrants. Therefore, we are taking legal action through Pre-trial at the District Court. South Jakarta. Evidently, Bareskrim Polri as the Respondent was not present at the trial. This is a struggle for friends from Africa and Nigeria in Indonesia. Here, they have been investors and entrepreneurs for more than 23 years. However, they have been wronged by elements members of the police at Bareskrim Polri,” he said.

On the Case Tracing Information System page of the South Jakarta District Court, case number 60/Pid.Pra/2023/PN JKT.SEL was registered on June 14, 2023 regarding the classification of a valid case or whether the determination of the suspect was not.
